关于进一步优化北京市房屋建筑和市政基础设施工程质量监督和施工安全监督手续办理流程的通知

  关于进一步优化北京市房屋建筑和市政基础设施工程质量监督和施工安全监督手续办理流程的通知

各区住房城乡建设委,东城、西城区住房城市建设委,经济技术开发区建设局,各有关单位:

  为进一步优化营商环境,切实推进“放管服”改革,实现政府对房屋建筑和市政基础设施工程(以下简称“房屋市政工程”)建设项目的科学合理监管,优化本市房屋市政工程质量监督和施工安全监督手续办理流程,督促参建单位履行主体责任,现将有关事项通知如下:

  一、按照《北京市住房和城乡建设委员会关于做好工程建设项目审批制度改革试点工作的通知》(京建发〔2018〕470号)有关要求,本市已实现工程质量监督注册、工程施工安全监督备案和建设工程施工许可证核发合并办理。建设单位办理施工许可时除提交施工许可申报材料外,无需再提交其他材料。在施工许可办理完成后,建设单位可在施工许可信息系统下载打印《北京市建设工程质量监督执法告知书》和《北京市建设工程安全监督执法告知书》(详见附件)。

  施工许可证核发后,施工许可信息系统按照本市房屋市政工程市区质量安全监督执法工作分工的有关文件规定,将工程信息自动推送至北京市建设工程质量监督执法管理平台(以下简称“质量监督平台”)和北京市房屋建筑和市政基础设施工程施工安全监督工作管理信息系统(以下简称“安全监督平台”)。市区住房城乡建设主管部门或其所属的工程质量安全监督机构应每天登录质量监督平台和安全监督平台查看工程施工许可信息。

  二、市区住房城乡建设主管部门或其所属的工程质量安全监督机构获知工程施工许可信息后,核实数据无误的,将该工程纳入本机构实施工程质量安全监督范围,及时联系工程建设单位、施工单位等工程建设责任主体,做好召开质量监督首次监督工作会和施工安全监督工作交底会等相关工作。

  三、市区住房城乡建设主管部门或其所属的工程质量安全监督机构应结合工作实际,依据《北京市房屋建筑和市政基础设施工程质量监督工作规定》和《北京市房屋建筑和市政基础设施工程施工安全监督实施办法》等相关规定,通过登录使用质量监督平台和安全监督平台的方式,开展日常质量安全监督执法工作。

  四、各区住房城乡建设主管部门要持续开展宣传引导和政策解读,做好改革措施的宣传和服务工作,通过多种形式及时宣传改革措施和取得成效。

  五、本通知自发布之日起执行。

  现着重提示及告知以下内容:

  一、工程各参建单位及有关人员应严格按照《建筑法》、《建设工程质量管理条例》、《北京市建设工程质量条例》、《北京市建设工程质量终身责任承诺制实施办法》(京建法〔2015〕1号)等法律、法规、规章和规范性文件要求开展建设工程质量管理工作,并按照现行国家及北京市建设工程相关规范、技术标准严格控制建设工程质量,切实履行各自主体责任,强化质量责任追究,保证建设工程质量。

  二、各参建单位应按照《北京市建设工程施工现场管理办法》(市政府令第247号)、《房屋建筑和市政基础设施工程质量监督管理规定》(建设部令第5号)等文件要求,加强建设工程施工现场管理,强化对涉及工程主体结构安全、主要使用功能的建筑材料及工程实体质量的管理,履行法定质量责任和义务,落实工程质量主体责任,保障建设工程施工顺利进行,促进安全、文明施工。

  三、各参建单位应严格按照相关文件要求,建立工程质量保证体系,完善工程质量管理制度,配备专业齐备、数量充足且具有相应能力的质量管理人员,并履行相关授权手续。施工单位项目经理、监理单位总监理工程师应分别按照住房城乡建设部印发的《建筑施工项目经理质量安全责任十项规定(试行)》(建质〔2014〕123号)、《建筑工程项目总监理工程师质量安全责任六项规定(试行)》(建市〔2015〕35号)等文件要求,严格履行各自安全质量责任。

  四、建设工程发生涉及结构安全的重大工程质量问题的,建设、施工、监理单位应当自发现之日起3日内报告住房城乡建设主管部门。工程质量事故发生后,事故现场有关人员应当立即向工程建设单位负责人报告;工程建设单位负责人接到报告后,应于1小时内向事故发生属地人民政府住房和城乡建设主管部门及有关部门报告。情况紧急时,事故现场有关人员可直接向事故发生属地人民政府住房和城乡建设主管部门报告。

  五、工程各参建单位应按照《大气污染防治法》和《北京市大气污染防治条例》相关要求,依法履行扬尘治理主体责任,大力推行施工现场精细化、标准化管理,全面提高绿色施工管理水平。

  六、建设单位应按照《房屋建筑和市政基础设施工程竣工验收规定》(建质〔2013〕171号)、《北京市房屋建筑和市政基础设施工程竣工验收管理办法》(京建法〔2015〕2号)、《北京市社会投资建设项目联合验收暂行办法》(京建发〔2018〕118号)、《北京市建设工程竣工联合验收实施细则(试行)》(京建发〔2018〕481号)的规定,依法组织工程竣工验收,完善相关竣工验收手续。

  七、工程参建单位或个人发现质量监督执法人员在建设工程质量监督管理工作中玩忽职守、滥用职权、徇私舞弊、违反规定插手干预工程建设或违反党风廉政建设规定的,应及时向所属监督机构举报。

  八、建设单位应当将本告知书要求书面告知监理、施工等参建单位。

  现着重提示及告知以下内容:

  一、工程各参建单位应当严格遵守《中华人民共和国建筑法》《建设工程安全生产管理条例》和《北京市建设工程施工现场管理办法》等工程建设有关法律、法规和规范性文件的规定;严格执行国家基本建设程序;严格执行现行有关工程建设的规范、标准;建设、施工、监理单位应当依法对工程承担相应的安全生产责任。

  二、工程项目施工前,建设单位应向监督机构提供《危险性较大的分部分项工程清单》以及其他保证安全施工具体措施的资料(包括工程项目及参建单位基本信息)。

  三、工程各参建单位应当按照《北京市房屋建筑和市政基础设施工程施工安全风险分级管控和隐患排查治理暂行办法》(京建法〔2019〕3号)的要求开展安全风险分级管控和隐患排查治理工作,落实双重预防主体责任。

  四、被责令限期整改、停工整改的工程项目,施工单位应当在排除安全隐患后,由建设单位或监理单位组织验收,验收合格后形成安全隐患整改报告,经建设、施工、监理单位项目负责人签字并加盖单位公章,提交监督机构。

  五、工程项目因故中止施工的,建设单位应当向监督机构申请办理中止施工安全监督,并提交中止施工的时间、原因、在施部位及安全保障措施等资料。

  六、中止施工的工程项目恢复施工,建设单位应当向监督机构申请办理恢复施工安全监督,并提交经建设、监理、施工单位项目负责人签字并加盖单位公章的复工条件验收报告。

  七、工程项目完工后,竣工验收前,建设单位应当向监督机构申请办理终止施工安全监督,并提交经建设、监理、施工单位确认的工程施工结束证明,施工单位应当提交经建设、监理单位审核的工程项目安全生产标准化自评材料。

  八、工程安全事故发生后,事故现场有关人员应当立即向工程参建各单位负责人报告;工程参建各单位负责人接到报告后,应向事故发生属地人民政府住房和城乡建设主管部门及有关部门报告。

  九、工程各参建单位应当对向工程安全监督执法机构报送材料的真实性负责。工程安全监督执法机构对该工程进行的监督执法检查,不代替参建各方应当承担的相应安全责任。

  十、工程参建单位或个人发现安全监督执法人员在建设工程安全监督管理工作中玩忽职守、滥用职权、徇私舞弊、违反规定插手干预工程建设或违反党风廉政建设规定的,应及时向所属监督机构举报。

  十一、建设单位应当将本告知书要求书面告知监理、施工等参建单位。

Regulation on Further Improving Formalities Concerning Supervision of Construction Quality and Safety for Buildings and Municipal Infrastructure Projects in Beijing

Commissions of Housing and Urban-Rural Development of various districts, Commissions of Housing and Urban Development of Dongcheng and Xicheng districts, Construction Bureau of Beijing Economic-Technological Development Area as well as related units:

  In order to further improve business environment, press ahead with the reform of “delegating powers, improving regulation and optimizing services”, help the government achieve the scientific administration of buildings and municipal infrastructure projects (hereinafter referred to as “buildings and municipal projects”), optimize the formalities concerning supervision of construction quality and safety for building and municipal infrastructure projects and ensure that the entities in charge of construction fulfill their entity responsibility, the relevant issues are hereby notified as below:

  1. In accordance with the relevant requirements set forth in the Regulation of Beijing Municipal Commission of Housing and Urban-Rural Development on Carrying out Pilot Reform on Examination and Approval System of Construction Projects (Jing Jian Fa [2018] No. 470), the registration of construction quality supervision, putting construction safety supervision on record and approval and issuance of construction permit will be combined together to handle. When applying for construction permit, the entities in charge of construction may submit required application materials, with no other materials required. Once the construction permission is granted, the entities in charge of construction may download and print Notification of Beijing Municipal Construction Project Quality Supervision and Law Enforcement and Notification of Beijing Municipal Construction Project Safety Supervision and Law Enforcement (see appendixes) in the construction permission information system.

  Once the construction permit is issued, the construction permission information system will feed the construction project information to Beijing municipal platform for supervision and law enforcement of construction project quality (“quality supervision platform”) and Beijing municipal platform for supervision of construction safety of building and municipal infrastructure projects (“safety supervision platform”), as per the provisions in the relevant documents concerning the work division of quality and safety supervision and law enforcement of building and municipal infrastructure projects. The municipal and district-level commissions of housing and urban-rural development or their branches responsible for construction quality and safety supervision shall log on to the quality supervision platform and the safety supervision platform on a daily basis to inquire construction permission information.

  2. Once the municipal and district-level commissions of housing and urban-rural development or their branches responsible for construction quality and safety supervision receive and verify the construction permission information, they will include the projects involved in their construction quality and safety supervision range, keep in timely contact with the entities in charge of construction, entities undertaking projects and other responsibility entities, as well as smoothly hold the first quality supervision work meeting and construction safety supervision explanation/clarification meeting.

  3. The municipal and district-level commissions of housing and urban-rural development or their branch responsible for construction quality and safety supervision shall, take into account practical work situation, carry out routine supervision and law enforcement for construction quality and safety by logging on to the construction quality supervision platform and the construction safety supervision platform in accordance with Regulations of Quality Supervision on Beijing’s House Construction and Municipal Infrastructure Projects and Regulations of Construction Safety Supervision on Beijing’s House Construction and Municipal Infrastructures Projects.

  4. Each of district commissions of housing and urban-rural development shall carry out publicity, guidance and interpretation of reform policies and measures, provide good services and make public the results in time through various forms.

  5. The Regulation shall take effect as of the date of promulgation.

Notification of Beijing Municipal Construction Project Quality Supervision and Law Enforcement

    Please note and be aware of the followings:

I. The participating entities and personnel of the project must strictly follow the requirements of laws, regulations, rules and specifications, including Construction Law, Regulation on Quality Management of Construction Projects, Regulations of Beijing on the Quality of Construction Projects, Implementation Measures of Beijing on Quality Lifelong Responsibility and Commitment System of Construction Projects (Jing Jian Fa [2015] No. 1), to perform quality management of construction projects. Moreover, they should strictly control the quality of construction projects, earnestly fulfill their respective main responsibilities, strengthen the investigation of quality responsibility and ensure the quality of construction projects in accordance with the current state and Beijing norms and technical standards.

II. All the participating entities must strengthen the onsite management of construction projects, enhance the control and management of building materials and actual quality related to the main structure safety and main functions of the project, perform the legal quality duties and obligations, fulfill the main responsibilities of project quality, safeguard the smooth construction process, facilitate the safe and civilized construction, in accordance with requirements stipulated in Measures of Beijing Municipality for the Administration of Construction Sites (No. 247 Order of The People’s Government of Beijing Municipality), Provisions on the Supervision and Administration of Quality Management of  Housing and Municipal Infrastructure Construction Projects (No. 5 Order of Ministry of Housing and Urban-Rural Development), and other documents.

III. All the participating entities should comply with the relevant documents strictly to establish a quality assurance system for construction projects, perfect the construction quality management system, assign sufficient quality personnel with complete equipment and qualified capabilities, and go through the related authorization procedures. Project managers from entities undertaking the projects, and general supervising engineers from supervision companies should separately comply with the requirements provided in Ten Regulations on Quality Safety Responsibilities for Construction Project Manager (Trial) (Jian Zhi [2014] No. 123), Six Regulations on Quality Safety Responsibilities for General Supervising Engineer of Construction Project (Jian Shi [2015] No. 35), and strictly fulfill their respective safety and quality responsibilities.

IV. If major construction quality issues involving structure safety are identified, the entity in charge of construction, entity undertaking the project and supervision company should report to the local competent department of housing and urban-rural development within three (3) days from the date of identification. In case of quality accident, the personnel concerned at the scene of the accident should immediately report to the project leaders of entity in charge of construction. Upon the receipt of report, the project leader of entity in charge of construction should report to the local competent department of housing and urban-rural development and relevant departments where the project is located within one (1) hour. In case of emergency, the personnel concerned at the scene of the accident may report directly to the local competent department of housing and urban-rural development where the project is located.

V. All the participating entities should, in accordance with the relevant requirements of the Law on the Prevention and Control of Atmospheric Pollution and the Regulations of Beijing Municipality on Atmospheric Pollution Prevention and Control, fulfill the main responsibilities of dust control and treatment, vigorously promote the refined and standardized management of construction site, and comprehensively improve the management of green construction.

VI. Entities in charge of construction should apply for completion acceptance and go through the related procedures in accordance with Administrative Measures for the Filing of As-built Inspection of Housing, Building and Municipal Infrastructure Projects (Jian Zhi [2013] No. 171), Administrative Measures of Beijing Municipality for the Completion Acceptance of Housing Construction and Municipal Infrastructure Projects (Jing Jian Fa [2015] No. 2), Interim Measures of Beijing Municipality for Joint Inspection Acceptance of Social Investment Construction Projects (Jing Jian Fa [2018] No. 118), and Implementation Rules for Beijing Construction Project Joint Acceptance (Trail) (Jing Jian Fa [2018] No. 481).

VII. In case that a participating entity or individual of the project finds that, in the performance of construction quality supervision and law enforcement, the person in charge of quality supervision and law enforcement neglects his/her duties, abuses his/her powers, engages in malpractices, violates the regulations, interferes with construction, or breaks the rules for the construction of Party conduct and clean and honest administration, such entity or individual shall report to the corresponding supervision agency in a timely manner.

VIII. The entity in charge of construction please forward the requirements specified in this Notification to the participating entities, including supervision companies and entities undertaking projects, in writing.                      

Appendix 2

Notification of Beijing Municipal Construction Project Safety Supervision and Law Enforcement

Please note and be aware of the followings:

I. All the participating entities of the project must strictly follow the provisions stipulated in the laws, regulations, rules and specifications related to construction projects, including Construction Law of the People’s Republic of China, Administrative Regulations on the Work Safety of Construction Projects and Measures of Beijing Municipality for the Administration of Construction Sites. They must adhere to the basic construction procedures of China, and comply with the current codes and standards. In addition, entities in charge of construction, entities undertaking projects and supervision companies should be responsible for the project safety production according to law.

II. Before the construction of the project, the entity in charge of construction should submit the List of Sub-projects and Works with High Risks and other documents of specific measures for construction safety (including basic information on construction project and participating entities).

III. All the participating entities of the project should make arrangements for safety risk classification management and control and hidden hazards investigation and management, and implement the main responsibilities for double preventions, based on the requirements of Safety Risk Classification Management and Control and Hidden Hazards Investigation and Management for Housing and Municipal Infrastructure Construction in Beijing (Jing Jian Fa [2019] No. 3).

IV. For the construction project that is ordered to be rectified or suspended for rectification within a time limit, entity undertaking the project should remove safety hazard, which would then be inspected and accepted by the entity in charge of construction or supervision company. A safety hazard rectification report should be prepared with signatures of project leaders and official seals of the entity in charge of the project, entity undertaking the project and supervision company after acceptance, and submitted to supervision agency.

V. For the project suspended due to any reason, the entity in charge of construction should apply to the supervision agency for suspension of construction safety supervision, and submit information on the time, reason, part and safety measures of the suspension.

VI. If the suspended construction project is resumed, the entity in charge of construction should apply to the supervision agency for resumption of construction safety supervision, and submit the acceptance report on construction resumption approved by project leaders and affixed with official seals of entity in charge of construction, supervision company and entity undertaking the project.

VII. After the completion of the project and before the acceptance, the entity in charge of construction should apply to supervision agency for the termination of construction safety supervision, and submit the construction completion certificate confirmed jointly by entities in charge of construction, supervision companies and entities undertaking projects. Entities undertaking projects should submit the self-evaluations on construction and production safety standards approved by entities in charge of construction and supervision companies.

VIII. In case of safety accident, the personnel concerned at the scene of the accident should immediately report to the project leaders of all participating entities. Upon the receipt of report, project leaders of all participating entities should report to the local competent department of housing and urban-rural development and relevant departments where the project is located.

IX. All the participating entities of the project should be responsible for the authenticity of data and documents submitted to the construction safety supervision and law enforcement agency. The safety supervision and law enforcement agency should supervise and inspect the law enforcement instead of bearing the safety responsibility assumed by the participating entities.

X. In case that a participating entity or individual of the project finds that, in the performance of construction safety supervision and law enforcement, the person in charge of safety supervision and law enforcement neglects his/her duties, abuses his/her powers, engages in malpractices, violates the regulations, interferes with construction, or breaks the rules for the construction of Party conduct and clean and honest administration, such entity or individual shall report to the corresponding supervision agency in a timely manner.

XI. The entity in charge of construction please forward the requirements specified in this Notification to the participating entities, including supervision companies and entities undertaking projects, in writing.
