  为进一步深化“放管服”改革,优化营商环境,加强我市工程质量管理,充分发挥工程监理质量安全监督职责作用,促进首都建筑业持续健康发展,依据《建设工程质量管理条例》《建设工程安全生产管理条例》《北京市建设工程质量条例》《建设工程监理规范》,市住房城乡建设委研究制定了《北京市房屋建筑和市政基础设施工程监理人员配备管理规定》,现印发给你们,请认真遵照执行。

  监理人员配备管理规定

  

  第一章   总则

  第一条 为规范管理施工现场监理人员配备,充分发挥监理作用,提高首都工程质量安全水平,依据《建设工程质量管理条例》《建设工程安全生产管理条例》《北京市建设工程质量条例》《建设工程监理规范》等国家和本市相关法律法规、规范,制定本规定。

  第二条 北京市行政区域内,按照有关规定应当实行工程建设监理的房屋建筑和市政基础设施工程的项目监理机构人员配备及其政府监督管理,适用本规定。

  第三条 监理单位应根据工程项目特点和技术复杂程度,满足不同类型、不同规模和不同阶段工程项目监理人员配置要求。现场监理人员配备还应遵守建设工程监理合同的约定。

  第四条 项目监理机构应当设置总监理工程师、专业监理工程师、监理员等岗位,必要时设总监理工程师代表,其中总监理工程师、总监理工程师代表和专业监理工程师属于关键岗位专业技术人员,应具备相应的任职条件。

  第五条 监理单位对工程施工安全风险分级管控和隐患排查治理工作负监理责任,应当建立施工安全风险分级管控和隐患排查治理监理工作制度,将相应监理工作列入监理规划,制定相应的监理实施细则,定期对项目监理机构落实情况进行检查。监理人员应具备施工现场安全风险评估和事故隐患排查能力。

  第二章   总监理工程师

  第六条 总监理工程师应当具备以下条件:

  (一)具有注册监理工程师资格;

  (二)工程类相关专业大学本科及以上学历;

  (三)具有3年以上监理工作经验;

  (四)熟悉掌握相关法律法规和工程建设标准、规范;

  (五)具有一定的组织协调能力和良好的职业道德。

  第七条 总监理工程师应由注册在本单位的注册监理工程师担任,经所属监理单位法定代表人任命并授权,并在建设工程监理合同中载明。

  第八条 一名注册监理工程师宜担任一项建设工程的总监理工程师,当需要兼任其他建设工程的总监理工程师时,应经建设单位书面同意,且最多不得超过三项。

  第九条 下列建设工程的总监理工程师在工程施工期间不得兼任其它工程的总监理工程师:

  (一)列入本市重点项目计划,单体10万平方米及以上的非住宅项目;

  (二)城市轨道交通工程;

  (三)建筑规模10万平方米及以上保障性安居工程项目或超过30万平方米的普通住宅工程;

  (四)投资超过5亿元的市政公用工程;

  (五)建设工程监理合同约定的其他工程。

  第十条 第九条(一)至(四)款的工程项目,总监理工程师应具有类似工程业绩;对于超限高层建筑、城市轨道交通工程及列入本市重点项目计划且单体10万平方米以上的非住宅项目,总监理工程师还应同时具有建筑或市政相关专业高级工程师或以上专业技术职称。

  第十一条 总监理工程师任命后因故确需更换的,新任命总监理工程师资历条件不得低于招标文件要求的总监理工程师的条件,并应经建设单位书面同意。

  第三章    其他监理人员

  第十二条 总监理工程师代表、专业监理工程师、监理员等其他监理人员,其任职条件和签字权限应符合相关规定。

  第十三条 根据工程特点、规模、技术复杂程度和工作需要,监理单位可在项目监理机构设总监理工程师代表。总监理工程师同时兼任其它建设工程总监理工程师时,应在项目监理机构设总监理工程师代表。

  第十四条 总监理工程师代表应由总监理工程师书面授权,经监理单位法定代表人同意,并通知相关单位。授权范围不得违反《建设工程监理规范》等有关规定。

  第十五条 总监理工程师代表应由具备注册监理工程师资格的人员、或具有其他工程类注册执业资格经监理业务培训合格的人员、或具有中级及以上专业技术职称且具有三年及以上施工现场工作经验并经监理业务培训合格的人员担任。

  第十六条 总监理工程师代表不得兼管其它工程项目的监理工作。

  第十七条 专业监理工程师应由具有工程类注册执业资格的人员、或具有中级及以上专业技术职称且具有两年监理工作经验并经监理业务培训合格的人员担任。

  第十八条 监理员应具有与所承担岗位工作相适应的学历或工作经验,并经培训合格后上岗。

  第十九条 项目监理机构人员应专业配套齐全、年龄结构合理、人员资格满足建设工程监理合同约定和现场监理工作需要。

  第二十条 项目监理机构更换总监理工程师代表或专业监理工程师的,应书面通知建设单位和施工单位。

  第四章    监理人员配备数量要求

  第二十一条 项目监理机构的人员应根据项目性质、工程特点和专业需求配备,数量应满足不同施工阶段监理工作的需要和建设工程监理合同的约定。

  第二十二条 新建公共建筑和市政公用工程,项目监理机构人员配置数量最低不少于3人。根据工程规模或工程投资额的增加,应相应增加项目监理机构人员配备。新建公共建筑、住宅工程和市政公用工程,项目监理机构人员最低配备参考标准见附件。

  第二十三条 轨道交通工程按照《轨道交通施工现场安全质量主要管理人员配备的指导意见》(京建发〔2014〕72 号)相关要求执行。

  第五章    项目监理机构管理

  第二十四条 监理单位应当加强对现场监理人员的管理,每季度应当至少组织一次对项目监理机构的人员配备和履职情况的检查考核,发现不能胜任工作或履职不到位的,应及时进行调整。

  第二十五条 监理单位应当加强对监理人员的培训和继续教育,按照国家相关要求,保证监理人员继续教育的学时和效果,督促监理人员更新知识,不断提升业务能力和监理工作水平。

  第二十六条 建设单位应当按照监理合同要求,检查项目监理机构人员配置和监理履职情况,发现问题及时要求监理单位整改;对于屡次提出问题监理单位没有改进或严重违反合同约定的,建设单位有权依照合同约定提出终止合同。

  第二十七条 建设单位应当为监理履职创造条件,不得干预监理正常工作程序,不得以任何理由明示、暗示监理单位放松对质量安全的管理工作。

  第六章    监督管理

  第二十八条 市、区两级建设行政主管部门应加强对工程监理人员配备情况的监督管理,在监督执法检查中发现项目监理机构人员配备不符合本规定要求的,应责令限期改正,对逾期未改正的,按照相关管理规定对责任单位和责任人员进行处理。

  第七章    附则

  第二十九条 本规定由市住房城乡建设委负责解释。

  第三十条 本规定自发布之日起施行。第六条适用于本规定实施后取得注册监理执业资格证书人员。

        In accordance with the Regulation on the Quality Management of Construction Projects, the Administrative Regulations on the Work Safety of Construction Projects, Regulations of Beijing on the Quality of Construction Projects, Code for Construction Project Management, upon the investigation of the Beijing Municipal Commission of Housing and Urban-Rural Development, the Administrative Provisions on the Staffing of Supervisors for Housing Construction and Municipal Infrastructure Projects in Beijing are hereby issued to you for your conscientious compliance and implementation, with a view to deepening “the reform of delegating powers, improving regulation and optimizing services”, optimizing the business environment, strengthening the municipal engineering quality management, giving full play to the role of quality and safety supervision of engineering supervision, and promoting the sustainable and healthy development of the construction industry of Beijing.

Administrative Provisions on the Staffing of Supervisors for Housing Construction

and Municipal Infrastructure Projects in Beijing

Chapter 1 General Provisions

         Article 1 In accordance with the Regulation on the Quality Management of Construction Projects, the Administrative Regulations on the Work Safety of Construction Projects, Regulations of Beijing on the Quality of Construction Projects, the Code of Construction Project Management and other related state and municipal laws, these Provisions are hereby formulated, with a view to standardizing the staffing of supervision personnel in construction site, giving full play to the role of supervision and improving the quality and safety level of projects in Beijing.

        Article 2 These Provisions shall apply to the staffing of the project supervision agencies for housing construction and municipal infrastructure projects under construction supervision and the supervision and management by the government within the administrative areas of Beijing.

        Article 3 In line with the characteristics and technical complexity of the project, the supervision unit shall meet the requirements of different types, scales and stages of project supervision staffing. The staffing of on-site supervision personnel shall also comply with the provisions of the supervision contract for construction projects.

        Article 4 The project supervision unit shall set up the posts of chief supervision engineer, professional supervision engineer and supervisor, and if necessary, the representative of chief supervision engineer. The chief supervision engineer, the representative of chief supervision engineer and the professional supervision engineer are the professional and technical personnel in key positions, and should possess corresponding qualifications.

        Article 5 The supervision unit shall bear supervision responsibilities for classified engineering construction safety risk management and control and hidden hazard screening and elimination of the building projects, develop the work rules in this regard, include relevant supervision work in its supervision planning, formulate corresponding rules for supervision implementation and regularly check the implementation status of the project supervision agency. Supervisors should possess the ability of safety risk assessment and accident hidden danger investigation on construction site.

Chapter II Chief Supervision Engineer

        Article 6 Chief supervision engineer shall meet the following conditions:

        (1) Qualification of national registered supervision engineer;

        (2) Bachelor’s degree and above with a major related to engineering;

        (3) More than three years experience of supervision;

        (4) Familiar with relevant laws and regulations and engineering construction standards and norms;

        (5) Have a certain organizational coordination capability and good professional ethics.

        Article 7 Chief supervision engineer shall be acted by the registered supervisory engineer registered with the unit, appointed and authorized by the legal representative of his supervision unit, and such authorization shall be specified in the construction supervision contract.

        Article 8 A registered supervision engineer shall act as the chief supervision engineer for one construction project. When it is necessary to serve as the chief supervision engineer of other construction projects concurrently, such arrangement shall be agreed in writing by the construction unit and the projects supervised concurrently shall not exceed three at most.

        Article 9 Chief supervision engineer of the following construction projects may not concurrently act as the chief supervision engineer of other projects during the construction period:

            (i) Included in the major urban project plan, non-residential projects with a single building area of 100,000 square meters or above; 

        (ii) Urban rail transit projects:

            (iii) Buildings with a construction scale of 100,000 square meters and above, or more than 300,000 square meters of ordinary residential projects;

        (iv) Municipal utilities projects with an investment of more than RMB 500 million;

        (v) Other projects stipulated in the construction supervision contract.

        Article 10 Chief supervision engineer shall have similar engineering performance for the engineering projects listed in Article 9 (i)-(iv); For over-limited high-rise buildings, urban rail transit projects and non-residential projects listed in the major municipal project plan and with a single building of more than 100,000 square meters, the chief supervision engineer shall also have the technical title of a senior engineer or above in construction or municipal related specialties.

        Article 11 If it is really necessary to replace the appointed chief supervision engineer, the qualification of the new supervision engineer shall not be lower than those of the chief supervision engineer required in the tender documents, and shall be agreed in writing by the construction unit.

Chapter III Other Supervision Personnel

        Article 12 Representatives of chief supervision engineers, professional supervision engineers, supervisors and other supervision personnel shall meet the relevant provisions in terms of their working conditions and signature authority.

        Article 13 In line with the characteristics, scale, technical complexity and work needs of the project, the supervising unit may set up a representative of the chief supervision engineer in the project supervision agency. When the chief supervision engineer concurrently serves as the chief supervision engineer of other construction projects, the representative of the chief supervision engineer shall be appointed in the project supervision agency.

        Article 14 The representative of the chief supervision engineer shall be authorized in writing by the chief supervision engineer, with the consent of the legal representative of the supervision unit, and the relevant units shall be notified. The authorization scope shall be subject to The Code of Construction Project Management and related regulations.

        Article 15 The representative of the chief supervision engineer shall be a person who possesses registered supervision qualification, or a person who possesses other engineering registered practicing qualification and is qualified after the training of supervision business, or a person who possesses intermediate or higher professional and technical titles with three years or more working experience in construction site and is qualified after the training of supervision business.

        Article 16 The representative of the chief supervision engineer shall not concurrently supervise other engineering projects.

        Article 17 The professional supervision engineer shall be a person with engineering registration qualification, or a person with intermediate or higher professional and technical titles and two years supervisory work experience and qualified after training in supervisory business.

        Article 18 Supervisors should have educational background or working experience appropriate to the job they undertake, and be qualified after training.

        Article 19 The project supervision unit should be fully equipped with professional supporting facilities and staffed in a reasonable age structure. The personnel qualification shall meet the requirements of contract provisions and on-site supervision of construction project supervision.

        Article 20 If a project supervision institution replaces a representative of the chief supervision engineer or a professional supervision engineer, it shall notify the construction unit and the construction unit in writing.

Chapter IV Quantity Requirements for Supervisors

        Article 21 The personnel of the project supervision unit shall be equipped in line with the nature of the project, the engineering characteristics and the professional requirements, and the quantity shall meet the requirements of the supervision work in different construction stages and the provisions of the construction supervision contract.

        Article 22 For new public buildings and municipal utilities, the minimum staffing of project supervision agencies is not less than three people. With the increase of project scale or project investment, the staffing of project supervision organization should be increased accordingly. For new public buildings, residential projects and municipal utilities, the minimum staffing standards for project supervision agencies are listed in the appendix.

        Article 23 The urban rail transit engineering shall be subject to related requirements of the Guidance on the Staffing of Main Managers of Safety and Quality in Rail Transit Construction Site (Jing Jian Fa [2014] No. 72).

Chapter V Management of Project Supervisory Agency

        Article 24 Supervisory units shall strengthen the management of on-site supervisors and organize at least one quarterly inspection and assessment of the staffing and performance of project supervisory agency. If any supervisors are found not competent or failed to perform their duties, the supervisory units shall make timely adjustments.

        Article 25 Supervisory units should strengthen the training and continuing education of supervisors, ensure the hours and effects of continuing education of supervisors, urge supervisors to update their knowledge and constantly improve their professional capability and supervisory standard in accordance with the relevant state regulations.

        Article 26 The construction unit shall, in accordance with the requirements of the supervisory contract, inspect the staffing and supervisory performance of the project supervisory agency, and promptly request the supervisory unit to rectify the problems found; if the supervisory unit repeatedly raises questions and fails to improve or seriously violates the contract agreement, the construction unit shall have the right to propose the termination of the contract in accordance with the contract.

        Article 27 The construction unit shall create conditions for performing the supervision duties, shall not interfere with the normal working procedures of supervision, express or imply that the supervision unit relaxes its management of quality and safety for any reason.

Chapter VI Supervision and Management

        Article 28 The competent authorities at the municipal and district levels should strengthen supervision and management over the staffing of project supervisors. If they find that the staffing of project supervisors does not meet the requirements of these regulations in the course of supervision and law-enforcement inspection, the supervision agency shall be ordered to make corrections within a time limit. If they fail to make corrections within the time limit, the responsible units and personnel shall be handled according to relevant management provisions.

Chapter VII Supplementary Provisions

        Article 29 These Provisions shall be interpreted by the Beijing Municipal Commission of Housing and Urban-Rural Development.

        Article 30 The Provisions shall go into effect on the date of promulgation. Article 6 is applicable to those who have obtained the qualification certificate of registered supervision after the implementation of these Provisions.
