(失效)关于优化社会投资房屋建筑和市政基础设施工程质量安全监督抽查工作的通知 (京建发〔2019〕25号)

  北京市住房和城乡建设委员会关于优化社会投资房屋建筑和市政基础设施工程质量安全监督抽查工作的通知

各区住房城乡建设委,东城、西城区住房城市建设委,经济技术开发区建设局:

  为进一步优化营商环境,切实推进“放管服”改革,实现政府对社会投资建设项目的科学合理监管,督促参建单位履行主体责任,防控社会投资建设项目质量安全风险,现将有关事项通知如下:

  一、本通知所称“社会投资建设项目”执行《关于进一步明确优化营商环境政策适用范围的通知》(市规划国土发〔2018〕159号)的规定,即指没有我国各级政府公共财政直接投资的建设项目。

  二、工程质量安全监督机构在制定工程质量安全监督计划时,应综合社会投资建设项目的工程规模、类别、施工总承包单位资质及安全风险情况等因素,按照本通知规定,科学合理确定监督抽查频次,优化质量安全监督抽查工作。

  三、市、区住房城乡(市)建设委依职责对已办理施工许可手续的、社会投资的中小型房屋建筑工程和市政基础设施工程(工程规模标准见附件1),按照《关于进一步优化营商环境深化建设项目行政审批流程改革的意见》(市规划国土发〔2018〕69号)、《关于社会投资建设项目分类标准的通知》(市规划国土发〔2018〕85号)的规定分为内部改造项目、现状改建项目和新建扩建项目等三类。

  四、对第三条述及的建设项目,质量安全监督抽查频次按以下原则确定。

  (一)内部改造项目和现状改建项目:质量安全监督机构至少开展1次监督抽查。

  (二)新建扩建项目:

  1.小型一般房屋建筑工程和小型城市道路、城市公共广场、城市排水等市政基础设施工程,质量安全监督机构至少开展1次监督抽查。

  2.中型一般房屋建筑工程和中型城市道路、城市公共广场、城市排水等市政基础设施工程,质量安全监督机构应在工程结构施工阶段、工程竣工验收阶段各至少开展1次监督抽查。当工程总承包企业资质高于工程规模要求的最低资质等级时,质量安全监督机构至少开展1次监督抽查。

  五、会议中心、博物馆、体育中心、音乐厅、电影院、夜总会、酒店/旅馆、购物中心、医院、学校/幼儿园等使用频率高、人员密集场所的建设项目,以及住宅小区工程的质量安全监督工作不适用本通知,其参建各方应严格按照现行法律法规及规范标准组织工程建设,保障工程质量安全。质量安全监督机构按相关规定依法开展监督工作。

  六、其他中小型非住宅类房屋建筑工程和市政基础设施工程可依据建设规模参照前述规定确定质量安全监督抽查频次。

  七、按本通知规定调整监督抽查频次的社会投资建设项目,实行建设、施工单位项目负责人承诺制。建设、施工单位项目负责人应填写《北京市社会投资项目建设、施工单位项目负责人质量安全承诺书》(见附件2),按照国家和本市现行的法律法规、标准规范组织工程施工,加强质量安全管理,保证工程质量,确保施工安全。

  八、如通过“北京市房屋建筑和市政基础设施工程安全风险分级管控与隐患排查治理双重预控管理平台”发现中小型工程存在重大风险,质量安全监督机构应在规定监督抽查频次的基础上,适当增加现场监督抽查频次,对重大风险管控、处理情况进行重点抽查。质量安全监督机构还应视建设、施工单位项目负责人履行承诺情况、动态监管记分情况,适时增加或减少监督抽查频次。

  九、中小型房屋建筑工程(住宅小区工程除外)和市政基础设施工程在建设过程中发生质量安全事故的,质量安全监督机构恢复有关规定的监督抽查频次。同时,市住房城乡建设委建立“重点监管对象清单”制度,对于列入“重点监管对象清单”的,质量安全监督机构应增加监督抽查频次,加强工程质量安全监督管理。

  十、本通知自发布之日起执行。

  Notice of the Beijing Municipal Commission of Housing and Urban-Rural Development on

  Optimizing the Random Spot Checks of Quality and Safety Supervision on

  Socially-Invested House Buildings and Municipal Infrastructure

Commissions of Housing and Urban-Rural Development of various districts, Commissions of Housing and Urban Development of Dongcheng and Xicheng districts, and Construction and Development Bureau of Beijing Economic-Technological Development Are:

  To further optimize business environment, substantially advance the reform of delegating powers, improving regulation and optimizing services, realize scientific and reasonable supervision of the government on socially-invested projects, urge the construction participants to fulfill their entity responsibilities and prevent and control the quality risks of the socially-invested construction projects, we hereby notify the relevant matters as follows:

  I. The socially-invested construction project described in the Notice herein shall conform to the provisions in the Notice on Further Defining the Applicability of the Policy for Optimizing Business Environment (Shi Gui Hua Guo Tu Fa [2018] No. 159), namely, it refers to any construction project without direct investment by the public finance of the governments of our country at various levels.

  II. While formulating engineering quality and safety supervision plans, the engineering quality and safety supervising agency shall comprehensive consider such factors as engineering scale, category, qualifications of the construction contractor and safety risks of the socially-invested construction project, define supervisory spot check frequency in a scientific and reasonable manner  and optimize quality and safety supervisory spot checks in accordance with provisions in the Notice herein.

  III. In accordance with the Opinions on Further Optimizing the Business Environment and Deepening the Reform of Administrative Approval Procedures for Construction Projects (Shi Gui Hua Guo Tu Fa [2018] No. 69) and the Circular on the Classification Standards for Construction Projects with Social Investment (Shi Gui Hua Guo Tu Fa [2018] No. 85), the municipal and district commissions of housing and urban-rural development will classify the small to medium socially-invested building construction projects and municipal infrastructure projects that have closed the construction permission formalities (See Appendix 1 for the criteria of engineering scale) into internal renovation project, reconstruction project and new or expansion project.

  IV. For the construction projects mentioned in Article III, the frequency of quality and safety supervision and check is defined in accordance with the following principles.

  1. Internal renovation project and reconstruction project:     The quality and safety supervisory agency shall conduct at least one supervisory check.

  2. New or expansion project:

  (1) In case of small-scale general building construction engineering and municipal infrastructure engineering such as small-scale urban road, urban public square and municipal drainage, the quality and safety supervisory agency shall conduct at least one supervisory check.

 

  (2) In case of medium-scale general building construction engineering and municipal infrastructure engineering such as small-scale urban road, urban public square and municipal drainage, the quality and safety supervisory agency shall conduct at least one supervisory check respectively on the structural construction stage and the completion acceptance stage. When the qualification of the project contractor is superior to the minimum qualification level required by the engineering scale, the quality and safety supervisory agency shall conduct at least one supervisory check.

  V. The Notice is applicable to neither the construction projects with high use frequency and highly crowd density such as conference centers, museums, sports centers, concert halls, cinemas, night clubs, hotels/hostels. shopping centers, hospitals and schools/kindergartens nor the quality and safety supervision of residential quarter engineering. All other construction participants shall organize engineering construction in strict compliance with the current laws, regulations, codes and standards to ensure the engineering quality and safety. The quality and safety supervisory agency shall carry out supervisory work in accordance with relevant provisions.

  VI. The quality and safety supervisory check frequency of other small to medium-scale non-residential building construction engineering and infrastructure engineering may be defined with reference to the aforesaid provisions.

  VII. The socially-invested construction project whose supervisory check frequency is adjusted  in accordance with the provisions in the Notice will adopt the system of commitment by the project leaders of the client and the construction unit. The project leaders of the client and the construction unit shall fill out the Quality and Safety Commitment by the Project Leaders of the Client and the Construction Unit of the Socially-invested Project of Beijing Municipality (Refer to Appendix 2), organize construction in accordance with the current laws and regulation, standards and codes of the state and Beijing, enhance quality and safety management, guarantee quality and ensure construction safety.

  If any major risk of a small or medium-scale project is located in the double pre-control and management platform for classified safety risk control and hidden risk elimination of building construction and infrastructure projects of Beijing, the quality and safety supervisory agency shall properly increase the site supervisory check frequency on the basis of the specified frequency and conduct key checks on major risk control and disposition. The quality and safety supervisory agency shall, depending on the commitment performance of the project leaders of the client and the construction unit and the status of the dynamic supervision scoring, also increase or decrease the supervisory check frequency as appropriate.

  IX. In case of any quality or safety accident in the construction process of the small to medium-scale building construction project (excluding residential quarter engineering) and the municipal infrastructure project, the quality and safety supervisory agency shall restore the supervisory check frequency specified. In the meantime, the Municipal Commission of Housing and Urban-Rural Development will establish the system of the “List of Key Regulatory Objects”. The quality and safety supervisory agency shall increase the supervisory check frequency for those listed to enhance engineering quality and safety supervision and management.

  X. This Notice will come into force as of the date of promulgation.

  Unit of the Socially-invested Project of Beijing Municipality

  

  The engineering herein falls on socially-invested        (Medium/small-scale)        (Building construction/municipal infrastructure. In line with the provisions in the Notice on Optimizing the Random Spot Checks of Quality and Safety Supervision on Socially-Invested House Buildings and Municipal Infrastructure, we hereby jointly make the following commitment:

  In strict compliance with relevant national and Beijing laws and regulations, standards and codes and documents including the Construction Law of the People's Republic of China, Regulations on the Quality Management of Construction Projects, the Regulations on the Work Safety Management of Construction Projects and the Regulations of Beijing Municipality on the Quality of Construction Projects as well as engineering design documents and contractual agreements, we will conscientiously fulfill the duties and obligations as the project leader, actively carry out self-inspection of quality and safety, timely eliminate potential quality and safety hazards and ensure that we won’t violate laws, standards codes, won’t reduce the construction quality of construction projects, and won’t cause construction safety related accidents.
